Terms of Service

These Terms of Service (“Terms”) govern the wedding officiant, ceremony, harmonica performance, and related services provided by Jerry L. Withers (“we,” “us,” or “our”). By booking, purchasing, or otherwise engaging our services, the client (“Client,” “you,” or “your”) agrees to these Terms.

1. Services

Jerry L. Withers provides wedding-related services that may include:

  • Wedding ceremony officiating
  • Personalized or customized wedding ceremonies
  • Elopement and vow-renewal ceremonies
  • Live harmonica music
  • Ceremony entrance, processional, interlude, recessional, or other requested music
  • Combined officiant and harmonica performance packages
  • Other wedding-related services specifically stated in the Client’s booking agreement or invoice

The exact services, date, time, location, fees, and other arrangements for your event will be specified in your booking confirmation, service agreement, invoice, or other written communication.

2. Booking and Reservation of Date

A wedding date and time are not considered reserved until Jerry L. Withers has accepted the booking and any required retainer or payment has been received.

Submitting an inquiry, requesting a quote, discussing availability, or receiving a proposal does not by itself reserve a date.

Bookings are accepted subject to availability.

3. Fees and Payment

The Client agrees to pay the fees stated in the applicable quote, invoice, booking confirmation, or service agreement.

A retainer may be required to reserve the event date and time. Unless otherwise stated in writing, the remaining balance must be paid by the deadline specified on the invoice or booking agreement.

Additional charges may apply for services or circumstances outside the original booking, including extended waiting time, substantial schedule changes, additional performance time, travel outside the standard service area, parking, venue fees, or other Client-requested additions.

Any additional charges will be communicated whenever reasonably practical.

4. Cancellations and Refunds

Cancellation terms applicable to a booking will be stated in the Client’s booking agreement, invoice, or confirmation.

Unless otherwise expressly stated in writing, retainers paid to reserve a specific wedding date and time are non-refundable because Harmony Ceremony may decline other bookings in reliance upon that reservation.

If the Client cancels after making additional payments, the refundability of those payments will depend upon the cancellation terms associated with the booking and any services already performed or expenses already incurred.

If Jerry L. Withers must cancel and is unable to provide the contracted services, payments made for services that will not be provided will be refunded, subject to any alternative arrangement mutually agreed upon with the Client.

5. Rescheduling

Requests to change the wedding date, ceremony time, or location are subject to availability and are not guaranteed.

Jerry L. Withers will make reasonable efforts to accommodate requested changes. Additional fees may apply when a change results in additional travel, preparation, waiting time, performance time, or other expenses.

A substantially changed date or time may be treated as a cancellation and new booking if Harmony Ceremony is unavailable for the revised event.

6. Client Responsibilities

The Client is responsible for providing accurate information concerning the ceremony, including the correct date, location, start time, contact information, venue requirements, and any special instructions.

The Client is also responsible for informing Jerry L. Withers of material schedule or location changes as soon as reasonably possible.

The Client is responsible for obtaining any permissions required by the venue for the officiant or live musical performance.

7. Marriage License

For legal marriage ceremonies, the couple is responsible for obtaining a valid marriage license from the appropriate governmental authority before the ceremony and for presenting the license and any required documentation to the officiant.

Jerry L. Withers does not guarantee that a marriage license will be issued or that a marriage will be legally recognized when the couple has failed to satisfy applicable legal requirements.

Jerry L. Withers will complete and handle marriage-license documentation within the scope required of the officiant by applicable law.

The couple is responsible for verifying the accuracy of the personal information contained on their marriage license and related documents.

8. Ceremony Content

Jerry L. Withers may provide standard ceremony wording or work with the couple to personalize their ceremony.

Requests for customized vows, readings, rituals, announcements, or other ceremony elements should be submitted sufficiently in advance to allow preparation.

Jerry L. Withers reserves the right to decline ceremony content or conduct that would require unlawful activity or create an unreasonable safety risk.

9. Harmonica Music Services

When live harmonica music is included in the booking, Jerry L. Withers will perform the musical selections agreed upon with the Client.

Specific song requests are subject to suitability for harmonica performance, sufficient preparation time, and prior agreement.

Certain songs may require adaptation or arrangement for harmonica and therefore may differ from the original recording.

Jerry L. Withers does not guarantee an exact reproduction of a commercially recorded performance.

10. Outdoor Ceremonies and Weather

For outdoor weddings, the Client is responsible for arranging a reasonable alternative or contingency plan in the event of extreme heat, rain, high winds, lightning, unsafe conditions, or other adverse weather.

Jerry L. Withers may delay, relocate, modify, or discontinue services when conditions reasonably present a threat to personal safety, equipment, or the ability to perform the contracted services.

11. Delays and Late Starts

Wedding schedules occasionally change. Jerry L. Withers will make reasonable efforts to accommodate minor delays.

Significant delays may affect the services provided, particularly when another event or commitment follows the Client’s scheduled ceremony.

If the ceremony begins substantially later than the contracted start time, Harmony Ceremony may need to shorten the service or leave at the end of the reserved service period.

Additional waiting-time charges may apply if specified in the Client’s booking terms.

12. Venue Requirements

The Client is responsible for informing Jerry L. Withers of venue rules, access restrictions, security procedures, parking requirements, sound limitations, insurance requirements, or other conditions affecting performance of the services.

Any parking, admission, access, or similar fees required for Jerry L. Withers to provide the contracted services may be charged to the Client unless otherwise agreed in writing.

13. Force Majeure

Jerry L. Withers will not be responsible for failure or delay in performing services caused by circumstances reasonably beyond its control, including severe weather, natural disasters, government restrictions, road closures, transportation emergencies, venue closures, widespread utility failures, civil emergencies, or similar events.

When reasonably possible, Jerry L. Withers will work with the Client to identify an appropriate alternative arrangement.

14. Illness or Emergency

If illness, injury, emergency, or another serious unforeseen circumstance prevents Jerry L. Withers from performing the contracted services, reasonable efforts may be made to assist the Client in locating a substitute officiant or musician when appropriate.

A substitute cannot be guaranteed.

If Jerry L. Withers cannot perform the contracted services and no acceptable substitute or alternative arrangement is provided, amounts paid for services that Jerry L. Withers is unable to perform will be refunded.

15. Photography, Video, and Recording

Guests and professional photographers or videographers may generally photograph or record the ceremony unless otherwise agreed.

The Client grants Jerry L. Withers permission to use photographs or recordings supplied by the Client or photographer only when the Client has the authority to grant such permission.

Jerry L. Withers will not use identifiable Client wedding photographs or video for advertising or promotional purposes without permission where such permission is required.

16. Intellectual Property

Original ceremony scripts, written materials, musical arrangements, website content, branding, and other original materials created by Jerry L. Withers remain the intellectual property of their respective owner unless otherwise agreed in writing.

Clients may use personalized ceremony materials for their own personal wedding and personal keepsake purposes.

17. Conduct and Safety

Jerry L. Withers reserves the right to discontinue services if the officiant or performer is subjected to threatening, violent, abusive, discriminatory, illegal, or seriously unsafe conduct.

Whenever reasonably possible, the Client or venue representative will be given an opportunity to address a correctable problem before services are discontinued.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Jerry L. Withers’ liability arising from the contracted services will not exceed the amount actually paid by the Client for the specific services giving rise to the claim.

Jerry L. Withers will not be responsible for indirect, incidental, consequential, or special damages to the extent such limitations are permitted by law.

Nothing in these Terms is intended to waive or limit any right or remedy that cannot legally be waived or limited.

19. Third-Party Services

Jerry L. Withers is not responsible for the acts, omissions, delays, or performance of independent venues, photographers, planners, musicians, transportation companies, marriage-license offices, booking platforms, payment processors, or other third parties.

20. Website Information

Jerry L. Withers attempts to keep information on HarmonyCeremony.com accurate and current. However, website content, pricing, packages, availability, and services may be changed periodically.

A Client’s confirmed booking will be governed by the pricing and services stated in the applicable booking agreement or confirmation rather than subsequent website changes.

21. Governing Law

These Terms and services provided by Jerry L. Withers will be governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where applicable law requires otherwise.

22. Entire Agreement

These Terms, together with the applicable booking agreement, invoice, confirmation, and any written amendments agreed upon by the parties, constitute the agreement between Jerry L. Withers and the Client concerning the contracted services.

If a specific provision in a signed service agreement conflicts with these general Terms, the provision in the signed service agreement will control for that booking.

23. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

24. Changes to These Terms

Jerry L. Withers may update these Terms periodically. Changes will apply prospectively and will be reflected by an updated effective date.

The terms applicable to an existing confirmed booking will not be materially changed after booking without agreement of the parties where required by law.

25. Contact
